2021 Interim Visa: Top 3 Pitfalls

If you have applied for the 2021 Resident Visa and your current visa is coming up for expiry you will automatically be granted a 2021 Interim Visa. In the week prior to expiry of your current visa you will be issued with the interim visa.

While the 2021 Interim Visa appears to be beneficial, you do need to be careful as it also presents some major pitfalls you should be aware of.

Pitfall #1: You cannot change your current visa conditions

If you are on an Essential Skills visa or Work to Residence visa, your options will be significantly limited while you remain on the 2021 Interim Visa. During this time you will be unable to change your job position, employer or location.

Usually, while on an Essential Skills visa, Work to Residence visa or other temporary work visa, you would be able to apply for a variation of conditions in order to change employment. Not so with the 2021 Interim Visa, nor are you allowed to apply for any other visa.

If you are on an (open) post-study work visa however, the 2021 Interim Visa could work in your favour. Look into your particular situation carefully and if you have any questions let us know.

Pitfall #2: You cannot re-enter New Zealand while on the 2021 Interim Visa

If you depart New Zealand while your 2021 Resident Visa is being processed and it is approved while you are overseas, you can return on your newly granted visa. However, if you leave the country on a 2021 Interim Visa you will be unable to return until your 2021 Resident Visa is approved, as your Interim Visa is automatically cancelled when you leave the country.

Pitfall #3: If your application for the 2021 Resident Visa is declined, you must leave New Zealand within two months

You do have the option to appeal. However, if you are on the 2021 Interim Visa when your application is declined, your Interim Visa will expire two months after the date your application is declined and you will be required to leave the country by the end of that two months.
