A major source of stress for migrants has often been business transitions, particularly when working for a company that is sold, merged, or restructured. This uncertainty can lead to concerns about job security and visa status. However, upcoming changes from Immigration New Zealand are streamlining the process for Accredited Employer Work Visa (AEWV) holders, providing stability and support during these times.

Simplified Process for AEWV Holders

Immigration New Zealand has revised the accreditation and Job Check requirements, making it easier for employers and AEWV holders to navigate business sales, mergers, or restructuring. Currently, if a business changes ownership, the new owner must hold accreditation to retain AEWV employees. In cases of redundancy, migrants need to find a new employer and apply for a Job Change on their visa. Without the new employer’s accreditation, this process can involve delays and uncertainty due to processing times.

From 6 November 2024, AEWV holders affected by these changes will be able to apply for a Job Change even if their new employer’s accreditation is still pending approval. This will allow Immigration New Zealand to process Job Change applications concurrently, reducing delays and uncertainty.

Key Points to Note

1. Job Check Requirement Removed
When the employer changes but the migrant’s role and location remain the same, the new employer will no longer need to complete a Job Check.

2. Quota Increase for Standard Accreditation
Employers with standard accreditation (allowing up to five AEWV holders) can apply to upgrade their accreditation if they need to hire additional AEWV holders. This upgrade application can proceed simultaneously with migrant employees’ Job Change applications.

3. Employer Applies First
New employers must submit their accreditation or upgrade application before AEWV holders submit their Job Change applications.
